General Rental Terms and Conditions
The equipment rental service is provided by Zimzala Surf Culture, owned by the company Watersmile, Lda (hereinafter referred to as “the rental company”). These rental terms and conditions are an integral part of the rental agreement. By accepting the general terms and conditions, the client confirms that they have read and fully accepted these terms.
Equipment Pick-Up
The client receives the equipment in good working condition. Any complaints must be made to the rental company at the time of pick-up.
Equipment Return
The client agrees to return the equipment at the end of the rental period as specified in the agreement and during opening hours. All equipment and accessories provided (wetsuits, leashes, etc.) must be returned in perfect condition. Loss or damage to accessories will be charged according to the current price list.
Responsibility
The client is responsible for the rented equipment and any damage caused to it or to third parties. In case of loss, damage or theft, the replacement cost of the item will be charged to the client, based on the values published by the rental company.
Important: Always store the equipment in a safe place and never leave it unattended in public areas. Handle the equipment with care to avoid damage.
Extension of the Rental Period
An extension of the rental agreement is only possible with prior consent from the rental company, before the current contract expires. The rental company reserves the right to refuse an extension without providing justification.
Minimum Client Age
The minimum age to rent equipment is 14 years.
Services and Prices
The prices published by the rental company, either in brochures or online channels, apply.
Insurance
The client is responsible for obtaining adequate insurance for the risks associated with the use of the equipment. The equipment is not insured against theft or damage.
Watersmile, Lda holds Allianz insurance policy nº 205421831, which covers only personal accidents during the rental period, up to €3,500 for medical treatment.
Note: In the event of an accident involving third parties, the insurance does not cover damage to third-party equipment or personal injuries. This responsibility lies entirely with the client, including any arrangements made with those involved.
Safety Equipment
Any safety equipment provided (e.g., helmet, flotation vest) must be used in all applicable situations. Insurance coverage will not be valid if mandatory safety equipment is not used.
Client Responsibility
The client agrees to use the equipment carefully, without endangering others, and in accordance with the provided safety instructions.
The client is fully responsible for any physical or material damage caused during the use of the equipment (Article 1023 of the Portuguese Civil Code). Zimzala Surf Culture is not responsible for accidents or damage suffered or caused by the client. Use in competitions or extreme conditions is prohibited.
In the event of an accident, loss, theft, or misuse, the client will be responsible for repair costs or, in the case of total damage, the full replacement value of the equipment.
Damage or Loss Policy
In-store: If the equipment is returned damaged, the repair cost will be charged according to the price list.
Off-site: In the event of serious damage or loss during use, the client must contact us immediately. The return of the equipment may be requested by taxi or other secure means. Transport and recovery costs are the client’s responsibility.
Repair kit (if applicable): Only one kit may be provided per rental, upon request at the start. It must be returned complete and in good condition (except for the inner tube if used). Non-return will result in an additional fee according to the price list.
Security Deposit
The rental company requires a credit card imprint, ID document, or credit card as a security deposit to cover loss, theft, or damage.
Applicable Law
This contract is governed by Portuguese law. In the event of a dispute, a mediator may be appointed by the parties or the court to seek an amicable resolution. If mediation is unsuccessful, the competent court will be that of the client’s residence. If multiple parties are involved, a common court may be appointed by mutual agreement or judicial decision.
Consumer Information:
Under Article 18 of Law no. 144/2015, in the event of a dispute, the consumer may resort to an Alternative Consumer Dispute Resolution Entity:
CIMAAL – Centro de Informação, Mediação e Arbitragem de Conflitos de Consumo do Algarve
(Centre for Information, Mediation and Arbitration of Consumer Disputes in the Algarve).
